COMING INTO FORCE OF PARENTAL UNION IN QUÉBEC: WHAT DOES IT MEAN?

July 1, 2025 — Under the Act respecting parental union, adopted in 2024 and in force since June 30, 2025, a new legal regime now applies to de facto spouses who become parents on or after that date.

This regime, incorporated into the Civil Code of Québec, establishes the rights and responsibilities of de facto spouses who become parents. Inspired by the family patrimony regime applicable to married couples, the parental union nevertheless provides for a distinct framework tailored to unmarried couples.

PRACTICAL GUIDE: THE FRANCIZATION PROCESS FOR BUSINESSES WITH 25 OR MORE EMPLOYEES

June 1, 2025 — Under the Act respecting French, the official and common language of Québec, adopted on June 1, 2022, several amendments were made to the Charter of the French Language.

One of these amendments requires businesses employing between 25 and 49 people in Québec to register with the Office québécois de la langue française (Québec Office of the French Language) in order to obtain a francization certificate, effective June 1, 2025.

By adopting Bill 42, entitled An Act to Prevent and Combat Psychological Harassment and Sexual Violence in the Workplace (the “Bill”), on March 27, 2024, the Government of Québec sent a clear message to employers, managers, executives, employees, unions, and even third parties.

WHY CAN EMPLOYERS NO LONGER REQUIRE A MEDICAL CERTIFICATE FOR CERTAIN SICK LEAVES?

January 22, 2025 — Since January 1, 2025, employers may no longer require employees to provide a medical certificate to justify a sick leave of three days or less.

This change is one of the key amendments introduced by the Act mainly to reduce the administrative burden on physicians (Bill 68).

BILL 62 RECEIVES ROYAL ASSENT: CHANGES TO THE RULES GOVERNING THE AWARD OF PUBLIC TENDERS

November 22, 2024 — On October 9, 2024, Bill 62, entitled An Act mainly to diversify the procurement strategies of public bodies and to provide them with greater flexibility in carrying out infrastructure projects (the “Bill”), received Royal Assent from the National Assembly of Québec.

Stay of the Application of Certain Provisions of the Act to Terminate Hydrocarbon Exploration

October 29, 2024 — A panel of five judges of the Québec Court of Appeal heard the appeal of a judgment ordering a stay of the application of certain provisions of the Act to Terminate Hydrocarbon Exploration and the Exploration of Underground Reservoirs, Hydrocarbon Production and Brine Exploitation.

THE POWER TO SANCTION ABUSE OF PROCESS: A REVIEW OF THE CASE LAW FOR 2023

THE NATIONAL ASSEMBLY ADOPTS BILL 31 ON HOUSING

February 21, 2024 — The National Assembly has adopted Bill 31, introduced by the Minister Responsible for Housing, France-Élaine Duranceau. The Act to amend various legislative provisions respecting housing (the “Act”) amends several Québec statutes, including the Civil Code of Québec.

STAY OF THE APPLICATION OF CERTAIN PROVISIONS OF THE ACT TO TERMINATE HYDROCARBON EXPLORATION

February 8, 2024 — The Québec Superior Court ordered a stay of the application of certain provisions of the Act to Terminate Hydrocarbon Exploration and the Exploration of Underground Reservoirs, Hydrocarbon Production and Brine Exploitation.
